As part of a commitment made in the trade agreement with the United States, the measure is intended to enable the continued smuggling of AI servers to China, which is currently difficult to penalise.
Taiwan is preparing to tighten controls on exports of advanced AI chips and AI servers to China, Economy Minister Kung Ming-hsin said in an interview with Bloomberg. This equipment will be added to the list of controlled goods: its shipment without authorization could then give rise to criminal prosecution under the Foreign Trade Law. The minister presents these changes as a counterpart to the reciprocal trade agreement signed with Washington, with some rules to be aligned with those of the United States. No date for entry into force has been given.
Until now, this equipment was not explicitly covered by the Taiwanese regime for sensitive technologies, which complicated the crackdown on misappropriation. In August, nine people were charged with illegally exporting 130 AI servers, 74 of which allegedly reached China via third countries under false documents; in the absence of appropriate text, the prosecutor's office had to retain breach of trust and forgery. The United States has restricted the export of advanced semiconductors to China since 2022.
